Terms of Service
Effective Date: September 27, 2026
These Terms of Service (“Terms”) govern access to the Color My Site Plan website and the purchase and use of services provided by Color My Site Plan LLC (“Color My Site Plan,” “we,” “us,” or “our”).
By submitting an order, making payment, uploading files, or otherwise using our services, you (“Customer,” “you,” or “your”) acknowledge that you have read, understood, and agreed to these Terms. If you place an order on behalf of a company or another person, you represent that you have authority to accept these Terms on their behalf.
1. Services
Color My Site Plan provides presentation-quality, two-dimensional graphic visualization of customer-supplied site plans.
Deliverables include a presentation-quality site plan rendering and may include an optional aerial-image overlay when purchased. The specific services, deliverables, and pricing applicable to an order are those shown on the order form at the time of purchase.
Unless otherwise expressly stated in writing, final deliverables are provided as PNG image files.
2. Graphic Visualization Only
Color My Site Plan provides graphic visualization services only.
Our services and deliverables do not constitute and must not be represented or relied upon as:
Engineering
Surveying
Architecture
Landscape architecture
Planning or zoning advice
Permitting or regulatory services
Construction documents
Technical design or analysis
Code or ordinance review
Verification of technical accuracy
Certification of existing or proposed conditions
Color My Site Plan does not independently investigate, measure, calculate, design, interpret, correct, or verify the accuracy, completeness, scale, geometry, dimensions, boundaries, materials, improvements, utilities, grades, vegetation, regulatory compliance, or other technical information shown in customer-provided files.
Our involvement does not create a professional engineer, surveyor, architect, landscape architect, consultant, fiduciary, or other licensed professional relationship with the Customer or any third party.
3. Customer-Provided Files
The Customer must provide all files and information required for the selected service. Required submissions may include a Lines PDF, Fills PDF, optional Aerial PDF, project scale, and any other requested instructions.
Submitted PDFs must:
Use the same page size, scale, orientation, viewport, and alignment
Retain their PDF layer information
Follow the current file-preparation requirements published on our website
Be complete and suitable for the requested rendering service
Color My Site Plan may delay, reject, or cancel an order if the submitted files are incomplete, corrupted, inaccessible, improperly aligned, missing required layer information, inconsistent with the file-preparation requirements, or otherwise unsuitable for processing.
Color My Site Plan is not responsible for delays, inaccuracies, omissions, or unsatisfactory results caused by customer-provided files or instructions.
4. Customer Responsibilities
The Customer is solely responsible for:
The accuracy, completeness, legality, and suitability of all submitted files and instructions
Confirming that submitted files align correctly and retain the required layer information
Providing the correct scale and other requested project information
Reviewing completed deliverables before using or distributing them
Confirming that deliverables accurately reflect the Customer’s intentions
Obtaining any necessary review or approval from the Customer’s engineers, surveyors, architects, landscape architects, attorneys, owners, agencies, or other qualified professionals
Determining whether a deliverable is appropriate for its intended use
Maintaining backup copies of submitted files and completed deliverables
The Customer must not use or permit anyone else to use a deliverable for engineering, surveying, architecture, construction, bidding, permitting, regulatory approval, property-boundary determination, quantity calculation, dimensional verification, technical decision-making, or verification of existing or proposed conditions.
The Customer assumes all risk arising from the use, distribution, modification, interpretation, or reliance upon a deliverable.
5. Rights to Submitted Materials
The Customer retains ownership of the original materials submitted to Color My Site Plan.
By submitting files, imagery, instructions, or other content, the Customer represents and warrants that:
The Customer owns the content or has all permissions necessary to provide it to Color My Site Plan
Color My Site Plan may lawfully use and process it to perform the requested services
The content does not violate intellectual-property, privacy, confidentiality, contractual, or other rights belonging to another person or entity
The Customer is authorized to request and receive the resulting deliverables
The Customer grants Color My Site Plan and its service providers a limited license to access, copy, modify, process, transmit, and store submitted materials as reasonably necessary to perform the services, administer the order, communicate with the Customer, maintain records, and protect our legal rights.
6. Automated Tools, Contractors, and Service Providers
Color My Site Plan may use automated processing, artificial-intelligence-assisted tools, independent contractors, and third-party technology platforms to prepare and deliver its services.
These services may include website hosting, form processing, cloud storage, file transfer, payment processing, email, analytics, and graphic-production tools.
By submitting an order, the Customer authorizes Color My Site Plan to process submitted materials through these tools and service providers as reasonably necessary to complete and administer the order.
Payment-card information is processed by third-party payment providers and is not directly stored by Color My Site Plan.
7. Orders and Payment
All prices are stated in United States dollars unless otherwise indicated.
Payment is due in full when an order is submitted. An order is not accepted and work will not begin until:
Payment has been successfully processed
All required files and information have been received
The submission has passed our initial file review
Submitting payment does not obligate Color My Site Plan to process files that do not satisfy our requirements.
The Customer is responsible for all applicable taxes, fees, and charges associated with an order. The Customer agrees not to initiate an improper payment dispute or chargeback for services delivered in accordance with the order and these Terms.
8. File Review and Order Acceptance
Color My Site Plan may review submitted files before beginning production.
If files do not meet our requirements, we may request replacement or corrected files. Production timing will not begin until all required corrections have been received and accepted.
We reserve the right to decline or cancel any order that:
Falls outside our stated service scope
Contains unsuitable or prohibited content
Presents technical, legal, security, or intellectual-property concerns
Cannot reasonably be completed from the submitted materials
Requires professional services that Color My Site Plan does not provide
Violates these Terms
If Color My Site Plan declines an order before beginning production, we may issue a refund or credit at our discretion. This discretionary exception does not create a general right to cancellation or refund.
9. Turnaround and Delivery
Any turnaround period shown on the website or order form is an estimate, not a guaranteed deadline.
Turnaround begins only after payment has cleared and all required files and information have been received and accepted. Customer delays, replacement files, revised instructions, technical problems, unusually complex submissions, third-party service interruptions, or circumstances beyond our reasonable control may extend delivery.
Color My Site Plan is not responsible for losses, expenses, deadlines, project delays, or other consequences resulting from an estimated delivery date not being met.
Delivery is complete when the deliverable is sent to the email address supplied with the order or otherwise made available to the Customer.
10. Revisions and Corrections
An order includes only the services, deliverables, and revisions expressly identified on the website or order form at the time of purchase.
A correction addresses a material failure by Color My Site Plan to reasonably reflect the properly prepared customer files and instructions accepted for the order.
Corrections do not include:
Changes to the underlying design or site plan
Replacement or ed source files
Changes to site geometry, boundaries, buildings, pavement, materials, scale, viewport, or orientation
New design instructions provided after production begins
Additional deliverables, formats, versions, or options
Changes caused by inaccurate, incomplete, improperly prepared, or misaligned customer files
Technical verification or professional design services
Subjective redesign beyond a reasonable adjustment to the original rendering
Requests outside the included correction round may require a new order or an additional fee.
Correction requests must clearly identify the issue and be submitted within 14 calendar days after delivery. If no correction request is received during that period, the deliverable will be considered accepted.
11. Artistic Interpretation and Visual Variation
The Customer acknowledges that the service produces a graphic representation rather than a construction or technical document.
Color selection, gradients, shadows, depth, vegetation appearance, material treatment, and other visual characteristics may involve standardized graphical interpretation.
Minor visual variation is inherent in the rendering process. Such variation does not constitute an error when the underlying site layout remains materially consistent with the accepted source files.
Color My Site Plan does not guarantee that colors will appear identical across monitors, software, printers, paper types, or other output devices.
12. Cancellations and Refunds
Except where Color My Site Plan expressly agrees otherwise in writing, all sales are final.
Orders cannot be canceled after file review and production have begun. Refunds are not provided for:
Customer dissatisfaction based solely on subjective preferences
Properly completed services
Customer errors or omissions
Improperly prepared or misaligned files
Incorrect scale or project information provided by the Customer
Changes to the design or source files after submission
Failure to use an included correction opportunity
Delays caused by the Customer
A decision not to use the completed deliverable
If Color My Site Plan determines before production begins that an order cannot be completed, we may issue a refund or credit at our discretion. Payment-processing fees and other nonrecoverable third-party charges may be deducted where permitted by law.
Nothing in this section limits any nonwaivable rights provided by applicable law.
13. Ownership of Deliverables
Upon full payment, the Customer may use the final deliverable for lawful business presentations, reports, exhibits, proposals, marketing, public engagement, internal review, and similar nontechnical purposes.
Color My Site Plan retains ownership of its rendering methods, workflows, software, templates, systems, processes, visual standards, know-how, and other underlying intellectual property. No ownership interest in those materials is transferred to the Customer.
The Customer may not:
Resell the rendering service as its own
Extract, copy, reverse engineer, or commercially exploit our rendering methods or production assets
Represent the deliverable as a technical document verified by Color My Site Plan
Remove or alter any required disclaimer included with a deliverable
Use the deliverable for an unlawful, misleading, or infringing purpose
14. Portfolio and Promotional Use
Unless the Customer requests confidentiality in writing before production begins, Color My Site Plan may display the completed rendering in its portfolio, website, social media, proposals, demonstrations, and other promotional materials.
Color My Site Plan will not publish the Customer’s source PDFs as portfolio material without separate permission.
We may identify a project using a general project name, project type, or location unless the Customer requests otherwise. We will not knowingly disclose information clearly identified by the Customer as confidential.
A Customer may request removal of a portfolio image by contacting us. We will make a reasonable effort to remove it from materials under our direct control, although removal from previously distributed materials, third-party caches, backups, or archived content may not be possible.
15. Prohibited Content and Conduct
The Customer must not submit or use our services in connection with content that:
Is unlawful, fraudulent, defamatory, threatening, or deceptive
Infringes intellectual-property, privacy, confidentiality, or contractual rights
Contains malware, executable content, scripts, embedded files, harmful code, or other security threats
Includes classified, export-controlled, protected health, financial-account, Social Security, or similarly sensitive information
Misrepresents the Customer’s authority, ownership, identity, or intended use
Is intended to facilitate unlawful conduct
Violates these Terms
We may refuse, quarantine, remove, or report prohibited content where reasonably necessary to protect our systems, service providers, customers, or legal rights.
16. Confidentiality and Data Security
Color My Site Plan will use reasonable administrative, technical, and organizational measures appropriate to the size and nature of our business and the information we process.
The Customer acknowledges that no method of electronic transmission, storage, automated processing, or cloud service is completely secure. Color My Site Plan cannot guarantee that submitted materials or other information will never be lost, corrupted, accessed without authorization, disclosed, altered, or destroyed.
The Customer should submit only the information reasonably necessary to perform the requested service and should maintain independent backup copies of all files and deliverables.

17. Disclaimers
Services and deliverables are provided on an “as is” and “as available” basis to the maximum extent permitted by law.
Color My Site Plan disclaims all express or implied warranties not expressly stated in these Terms, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, technical accuracy, regulatory compliance, uninterrupted availability, or suitability for construction, permitting, engineering, surveying, architecture, or other professional use.
We do not warrant that:
A deliverable is technically accurate or complete
Submitted files contain correct information
A deliverable complies with laws, codes, ordinances, approvals, or professional standards
The service will be uninterrupted or error-free
Every graphical interpretation will match the Customer’s subjective preferences
A deliverable will produce any particular business, marketing, permitting, approval, or project outcome
The Customer is responsible for obtaining appropriate professional review before relying on or distributing a deliverable.
18. Limitation of Liability
To the maximum extent permitted by law, Color My Site Plan and its owners, employees, contractors, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages.
This exclusion includes lost profits, lost revenue, lost opportunities, loss of data, project delays, construction costs, redesign costs, professional fees, reputational harm, or losses arising from the use of or inability to use a service or deliverable.
To the maximum extent permitted by law, the total cumulative liability of Color My Site Plan arising from or relating to an order, service, deliverable, or these Terms will not exceed the amount actually paid by the Customer to Color My Site Plan for the specific order giving rise to the claim.
These limitations apply regardless of the legal theory asserted and even if Color My Site Plan has been advised of the possibility of damages.
Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
19. Indemnification
To the maximum extent permitted by law, the Customer agrees to defend, indemnify, and hold harmless Color My Site Plan and its owners, employees, contractors, affiliates, and service providers from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or relating to:
Customer-provided files, imagery, instructions, or content
The Customer’s breach of these Terms
The Customer’s violation of applicable law
The Customer’s infringement of another person’s rights
The Customer’s use, modification, distribution, or representation of a deliverable
Use of a deliverable for a prohibited technical, regulatory, construction, or professional purpose
A dispute between the Customer and any owner, consultant, agency, contractor, client, or other third party
20. Third-Party Services
Our website and services may rely on third-party platforms, including Squarespace, Jotform, Stripe, Google, email providers, cloud-storage providers, and automated or artificial-intelligence-assisted tools.
Color My Site Plan does not control and is not responsible for the availability, security, operation, terms, privacy practices, or performance of third-party services.
Third-party interruptions, processing failures, security events, policy changes, or other issues may affect our ability to accept, process, or deliver an order. We will use reasonable efforts to address such issues but are not responsible for circumstances outside our reasonable control.
21. Suspension and Termination
Color My Site Plan may suspend or terminate access to the service, cancel an order, or refuse future service if the Customer:
Violates these Terms
Submits prohibited or potentially harmful content
Engages in fraud, abuse, harassment, or unlawful conduct
Initiates an improper chargeback or payment dispute
Misrepresents a deliverable or our services
Creates a security, legal, operational, or reputational risk
Termination does not eliminate payment obligations, ownership provisions, limitations of liability, indemnification duties, or other provisions that by their nature should survive termination.
22. Force Majeure
Color My Site Plan is not responsible for delay or failure caused by circumstances beyond our reasonable control.
These circumstances may include natural disasters, severe weather, fire, utility failures, internet outages, equipment failures, labor disruptions, governmental actions, public-health emergencies, cyberattacks, service-provider interruptions, or failures of third-party technology platforms.
23. Governing Law and Venue
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.
Any legal action arising from or relating to these Terms, an order, or our services must be brought in a state or federal court having jurisdiction in Mecklenburg County, North Carolina. The Customer consents to the personal jurisdiction and venue of those courts.
Before filing a legal action, the parties agree to make a reasonable good-faith effort to resolve the dispute informally.
24. Electronic Communications
The Customer consents to receive transactional communications electronically, including order confirmations, payment notices, file-review requests, correction communications, delivery emails, security notices, and updates relating to the service.
The Customer is responsible for providing and maintaining an accurate email address and for monitoring that address for communications concerning an order.
Electronic communications satisfy any requirement that a communication be provided in writing, except where applicable law requires otherwise.
25. Changes to These Terms
We may update these Terms periodically.
The version posted on the website at the time an order is submitted will generally govern that order unless the parties agree otherwise in writing or a change is required by law.
The revised Terms will be posted with an updated effective date. Continued use of the website or services after revised Terms become effective constitutes acceptance of the revised Terms.
26. Severability and Waiver
If any provision of these Terms is held invalid, unlawful, or unenforceable, the remaining provisions will remain in effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable where permitted by law.
A failure by Color My Site Plan to enforce any provision does not waive our right to enforce that provision or any other provision later.
27. Assignment
The Customer may not assign or transfer an order, these Terms, or any rights or obligations arising from them without the prior written consent of Color My Site Plan.
Color My Site Plan may assign these Terms or transfer its rights and obligations in connection with a merger, acquisition, financing, reorganization, sale of assets, or other business transaction.
28. Entire Agreement
These Terms, the applicable order form, the File Preparation Guide, and the Privacy Policy constitute the entire agreement between the Customer and Color My Site Plan concerning the purchased service.
If these documents conflict, the following order of precedence applies:
A separate written agreement signed by Color My Site Plan
The order form applicable to the purchase
These Terms of Service
The File Preparation Guide
The Privacy Policy
Any amendment must be agreed to in writing by Color My Site Plan unless these Terms expressly provide otherwise.
